Giveaway and Contest Rules
BlenderBottle® Retro Bottle Design Competition 2024
By entering into the BlenderBottle® Retro Bottle Design Competition (the “Contest”), you agree and accept these rules (the “Official Rules”) and the decisions of BlenderBottle®, which are final and binding. You further acknowledge that winning a prize is contingent upon fulfilling all the requirements set forth herein. This Contest is sponsored by Trove Brands, LLC, owner of the brand Blenderbottle® (hereinafter “BlenderBottle”).
How to Enter: Go to https://www.blenderbottle.com/pages/blenderbottle-retro-bottle-competition and to website to upload and submit a design using the submission method found on the website. All submissions must be uploaded by April 8, 2024 at 11:59pm MDT to be eligible. Files must be submitted in one of the following file formats: .png, .pdf, or .jpeg.
Design submissions that contain files that are unreadable by BlenderBottle upon receipt shall not qualify as a submission. Multiple submissions of the same design by a Participant shall be discarded and only one submission shall be used for the Contest.
Eligibility Rules: Entrants must be natural persons who are legal residents of, and physically located within the continental United States and be of the legal age of 18 at the time of entry. Each entrant may only have one entry in the Contest.
Employees of BlenderBottle and their immediate family members (spouses, parents, children, siblings and their respective spouses) are not eligible for the Contest regardless of where they reside. Those living in the same household as a BlenderBottle employee are not eligible for the Contest (whether related to the employee or not).
BlenderBottle’s computer systems shall be the official time-keeping device for Contest Contest. BlenderBottle reserves the right to, and may at any time and with or without advance notice, change, extend, or adjust the Contest Period and/or any of the start dates or end dates for the Contest.
All submissions must be the original work of the Entrant.
Submissions shall not include the copyright, trademark or other intellectual property of another person or entity.
Entries may not include designs or depictions that are defamatory, offensive, obscene, or controversial in nature. Examples include designs that use explicit language; nudity; images or phrases that are sexual in nature; racist content; any reference to illegal drugs or paraphernalia; politically-charged material; depict violent or illegal acts; contain graphic depictions of injury or death; and content that is demeaning or disrespectful to religions or religious figures.
The Contest is void where prohibited or restricted by law.
Winner Selection: By entering the Contest, each Entrant agrees that BlenderBottle’s decisions in regard to all related matters (including, without limitation, eligibility) shall be final and binding in all respects.
A submission judging committee consisting of BlenderBottle employees shall review all submissions and select 4 submissions based on attractiveness of the design, connection to the theme retro fitness, as well as the connection to the BlenderBottle® brand (the “Finalist”).
Upon selection by the committee as one of the Finalists, Entrant shall be contacted to confirm their eligibility and to complete any documents BlenderBottle requests in order to move to the final stage of the contest. BlenderBottle shall attempt to contact Entrant using the contact information provided along with their submission. Failure to respond to BlenderBottle within 24 hours shall result in the Entrant being disqualified and a new submission may be selected for participation as a Finalist. If Entrant fails to submit any additional documentation, complete any requested forms, or if for any reason Entrant and/or a submission is found to be ineligible for the Contest, a new submission may be selected for inclusion as a Finalist.
Any submissions selected as a Finalist which were not in a format deemed by the submission judging committee to be production ready shall be converted by a BlenderBottle® designer into a production ready format.
After selection and any necessary format conversion of the Finalist, BlenderBottle shall run a poll or other method of public survey through one or more of its social media channels. The beginning and end date of the survey as well as the method of participation shall be clearly stated on Instagram once the survey has begun. The Finalist submission that receives the most votes shall announced the winner of the contest.
It is anticipated that the Contest will conclude on April 30, 2024.
Honorary Mention:
BlenderBottle may, in its sole discretion, choose submissions to be used as designs on future BlenderBottle products. If BlenderBottle decides to use a submission as a design on a BlenderBottle product, such submission shall be deemed an Honorary Mention. Upon selection as an Honorary Mention, BlenderBottle shall attempt to reach out to the Entrant to obtain current contact information and for Entrant to complete any additional documentation necessary to award an Honorary Mention Prize. Failure to respond to BlenderBottle within 72 hours may result in the Entrant being ineligible for an Honorary Mention Prize, however the selected design may still be used on a BlenderBottle product. Ineligibility for an Honorary Mention award shall not limit BlenderBottle’s ability to use the submission as a design on a BlenderBottle Product. Entrants may contact the Contest sponsor through the methods below to update their contact information.
Prizes:
Winning Retro Bottle Design Prize: The Winning Retro Bottle Design Prize shall consist of: 1) US$1000.00; and 2) six (6) free bottles featuring the winner’s design submission. The $1000.00 prize may be in the form of cash, check, bank gift card or other form as deemed by BlenderBottle to be the most efficient form of transfer. BlenderBottle reserves the right to modify this prize by substituting alternative awards with an estimated value equal or greater than the prize listed in the Official Rules. Substitutions shall be made at BlenderBottle’s sole discretion and may be made at any time, with or without notice.
Honorary Mention Prize: If a submission is selected as an Honorary Mention, and the Entrant meets the eligibility requirements of an Honorary Mention Prize, Entrant shall receive six (6) free bottles featuring the Honorary Mention design submission. BlenderBottle reserves the right to modify this prize by substituting alternative awards with an estimated value equal or greater than the prize listed in the Official Rules. Substitutions shall be made at BlenderBottle’s sole discretion and may be made at any time, with or without notice.
Prize winner acknowledges that he or she is ultimately responsible for all federal, state and local taxes due in relation to the prize. Gift card prizes are subject to terms and conditions of the applicable gift card. All prizes are awarded “as is” with no warranty, guarantee or representations, either express or implied by BlenderBottle. No interest will be paid on any prize. All costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the prize recipient. Prizes are non-transferable and non-assignable, with no cash redemptions or substitutions, except at BlenderBottle’s sole discretion. There will be no substitutions for any prize except by BlenderBottle who reserves the right to substitute a prize with one of comparable or greater value at their sole discretion. All cash or cash equivalent prize amounts are listed in US dollars.
The number of Honorary Mention Prizes shall vary depending on the number and quality of entries to the Contest.
How to Claim Prize.
Winning Retro Bottle Design Prize:
BlenderBottle will notify the potential winners through a direct message using the contact methods provided with their submission at the time of their selection to be part a Finalist. BlenderBottle may also require a prize winner to sign a release for use of the winner’s name or other personal information in connection with Marketing, advertising or other publicity in connection with the Contest if they are selected as the Retro Bottle Design Prize winner. Failure to agree to such release may result in a forfeiture of the eligibility to participate as a Finalist and/or potential winner’s prize.
BlenderBottle will attempt to notify the potential Finalist and/or winner, but BlenderBottle is not responsible for any undelivered e-mails or messages, including without limitation e-mails that are not received because of a winner’s privacy or spam filter settings which may divert any Contest e-mail, including any winner notification e-mail, to a spam or junk folder. Other restrictions may apply.
Upon close of the public vote of the Finalists, BlenderBottle will attempt to contact the potential winner through the same methods used to during the selection of the Finalists. Some final documents, may be required to be completed and returned to BlenderBottle to claim the Retro Bottle Design Prize.
If any winner does not claim their prize within 3 days, fail to return any requested documentation in a timely manner, or fail to comply with the Official Rules in any way, any such prize may in BlenderBottle’s sole discretion, be forfeited.

Additional Terms and Conditions: BlenderBottle reserves the right to disqualify any Entry or other material submitted or uploaded that does not meet the requirements of these Official Rules.
By entering the Contest and submitting any Entry as described above, Entrant agrees to comply with all applicable terms of service, privacy policies and applicable terms and conditions of Instagram or any social media platform BlenderBottle may use to run the public survey of the Finalists. Note that Entrant’s wireless service provider may charge the Entrant for applicable data charges if Entrant uses their mobile device for any portion of this Contest. Entrants should consult their wireless service providers regarding pricing plans. Message and data rates may apply. Entrants should review their mobile device’s capabilities for specific application instructions.
Warranty. By entering the Contest, each Entrant represents, warrants and covenants that (a) each Entry is the Entrant’s original work and does not infringe upon or otherwise violate any right of any third party, including any copyright, trademark or other intellectual property rights, (b) each Entry has not been previously published, (c) each Entry complies in all respects with the Entry Restrictions and these Official Rules, and (d) the Entrant has the right and power to enter the Contest and perform all the Contest obligations.
Ownership Rights. By submitting a design as part of their entry into the Contest, Entrant does thereby assign to BlenderBottle and/or its parent company or subsidiary, all rights in the design, including but not limited to copyright, trademark, or design patent. Entrant also agrees to execute any document necessary to perfect such rights. In addition, BlenderBottle is expressly entitled to improve, develop and create derivative works of the Work Product, in whole or in part (collectively, "Derivative Works"), alone or jointly with third parties and, as between the Parties, BlenderBottle shall own all right, title and interest to the Derivative Works. As relevant, Entrant also agrees to waive or assign to BlenderBottle any moral or neighboring rights or rights of attribution Entrant may have in the submission or any Derivative Works. Assignment of any and all right related to the submission shall be valid, regardless of whether Entrant wins the prize or not.
By submitting a design as party of an entry, Entrant agrees that they will not use the submission or a Derivative Work of the submission for any commercial use, and shall not submit it for publication or use in any other Contest without BlenderBottle’s express written permission.
Entrant does also acknowledge that BlenderBottle may use any submission or Derivative Work of a submission as a design on BlenderBottle Products without any further payment or compensation. This right is not dependent on the Entrant winning any prize, and is perpetual and irrevocable.
Privacy. By participating in the Contest, each Entrant authorizes BlenderBottle to collect, use, process, transfer, and store all data provided by such Entrant, including without limitation personal data, in and to the United States or any location(s) throughout the world that BlenderBottle deems necessary, whether within Entrant’s country of residence or elsewhere, and with such party/parties as BlenderBottle deems appropriate, for purposes of administration of the Contest. All information submitted to BlenderBottle as part of this Contest will be treated in accordance with BlenderBottle’s privacy statement, available at https://blenderbottle.com/pages/privacy-policy. Personal information will be used only to: (a) provide information about the Contest; (b) contact and publicize potential winners. Entrants to the Contest may be given the option to receive commercial e-mails from BlenderBottle; however, eligibility to participate in the Contest is not dependent upon the Entrant’s consent to receive such e-mails. Entrants must fully complete and submit all non-optional data requested on the online entry form to be eligible.
Release and Limitations on Liability. By participating in the Contest, Entrants agree to release and hold harmless BlenderBottle and each of its respective affiliates, sales representatives, distributors, licensees, agents, advertising and Contest agencies, and all directors, trustees, officers and employees of any of the foregoing entities (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest, or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, misdirected, incorrect, garbled, or incompletely received entries; (e) errors in the administration of the Contest or the processing of entries; (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant's participation in the Contest or acceptance, receipt, use, or misuse of any prize; or travel to any Contest-related events; and (g) any claims based on publicity rights, copyright/trademark infringement, intellectual property rights, defamation or invasion of privacy and merchandise delivery. In the event that Entrant breaches any of these Official Rules, Released Parties shall be entitled to and may seek indemnification from Entrant for recovery of all legal fees, damages, costs, claims and other expenses that may be incurred by Released Parties as a result of the aforementioned breach. Entrant further agrees to release the Released Parties and their designees and assigns from any liability whatsoever, and waive any and all causes of action, for any claims, costs, injuries, losses and damages of any kind arising out of or in connection with the Contest or acceptance, possession, or use of any prize (including, without limitation, attorneys’ fees, claims, costs, personal injuries, losses and damages related to personal injuries, death, damage to or destruction or property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. BlenderBottle is not responsible if any prize cannot be awarded due to delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism.
Miscellaneous. The decisions of BlenderBottle are final with respect to all aspects of this Contest. The Contest and these Official Rules will be governed, construed and interpreted under the laws of the State of Utah, without regard to choice of law principles. Except where prohibited, each Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the applicable state or federal courts situated in Utah County, Utah; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys’ fees; (3) under no circumstances will Entrant be permitted to obtain awards for punitive, incidental, special, consequential or other damages, including without limitation, lost profits, (collectively, “Special Damages”); and (4) Entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims. In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problems, or any condition caused by events beyond the reasonable control of BlenderBottle that may cause the Contest to be disrupted or corrupted, BlenderBottle may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize from among the non-suspect, eligible entries received up to the time of the impairment. BlenderBottle reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process, the operation of the Contest, to be acting in violation of these Official Rules or any applicable laws relating to the Contest, or in an unsportsmanlike or disruptive manner, and to resolve all disputes in its sole discretion. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, BlenderBottle reserves the right to seek damages from any such person to the fullest extent permitted by law. BlenderBottle’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
